Agreement to Terms and Conditions.
These Home Pickup Terms and Conditions (the “Terms and Conditions”) apply to your use of Canada Post’s Home Pickup service. By clicking “I accept the terms and conditions” to the Terms and Conditions, you confirm your acceptance of the Terms and Conditions and create a legally binding contract with Canada Post Corporation (“Canada Post” or “ we” or “us”).
These Terms and Conditions affect your legal rights and responsibilities. Without limiting the foregoing, you assume full responsibility and liability for: (i) any failure to comply with these Terms and Conditions, and (ii) your use and/or attempted use of the Home Pickup service.

Home Pickup Service.
Home Pickup Service (“Home Pickup”) allows eligible consumers to have their eligible return packages (packages that were shipped to you by the merchant) or outbound packages (packages that are shipped by you) picked up from the comfort of their own home.
We may terminate Home Pickup at any time without notice.

Eligibility Requirements.
To be eligible for Home Pickup, you must satisfy each of the requirements set out below.

Eligible Customers - Consumers Only. You are requesting Home Pickup as a consumer. For the avoidance of doubt, businesses, corporations, or organizations are not eligible for Home Pickup.

Eligible Residential Dwelling & Location.

Your home is either of the following:
- A single-family residential dwelling that is detached, semi-detached, or attached in a row; or
- A residential unit in a multi-unit dwelling that consists of three or more self-contained units sharing a common indoor area or front entrance (e.g. an apartment or condo).

Subject to 3(b)(i), Home Pickup is available at your residential address.

Eligible Items.

Canada Post Shipping and Returns Only. You are only using Home Pickup to: (1) return items that were originally shipped to you by a merchant using Canada Post’s parcel services which requires that you use a Canada Post parcel returns label that was provided to you by the merchant; or (2) ship an outbound item using Canada Post’s parcel services.

Item Contents. You must ensure that your item does not contain any non-mailable matter (also referred to as “prohibited items”) or controlled items. Refer to our "Restrictions on personal shipping" page and the Canada Postal Guide at canadapost.ca/postalguide under Non-mailable matter for details.

Packaging & Labeling. You must ensure your item(s) is/are securely packaged, and that a Canada Post shipping label is affixed to the package in accordance with Canada Post’s packaging and labeling requirements. Refer to the Canada Postal Guide at canadapost.ca/postalguide under ABCs of Mailing for details.

Package Weight and Dimensions. The packaged item(s) fall within the specifications set out below:

No one dimension may exceed 2 m (78.7 in)
Max. L + G = 3 m (118 in.)*

*L = length; G = girth (girth is the distance around the item, measured at right angles to the length)

What to do on your Scheduled Pickup Date.
On your scheduled pickup date, you must ensure your Eligible Item(s) (hereinafter referred to as “Item(s)”) are available for pickup by Canada Post’s delivery agent in accordance with either of the following, as applicable to your type of dwelling:

Pickup Item(s) Left Unattended at Door - Applicable Only to Pickup from a Single-Family Dwelling. You may leave your unattended Item(s) outside your door where it is sheltered from the weather for pickup on your scheduled pickup date, prior to Canada Post’s scheduled pickup window of 9:00 a.m. to 5:00 p.m. You understand that you are leaving your Item(s) unattended at your own risk.
Canada Post will not pick up unattended Item(s) (including without limitation, Item(s) left in a parcel locker) if you reside in a multi-unit dwelling.

Pickup Item(s) by Personal Handoff - Applicable to Pickup from a Single-Family or Multi-Unit Dwelling. Ensure someone is home and available from 9:00 a.m. to 5:00 p.m. on the scheduled pickup date to hand your Item(s) to Canada Post’s delivery agent.

Requesting Home Pickup.
To request Home Pickup, download the Canada Post mobile application (the “App”) and select “Schedule a Home Pickup” from the “More” menu. The address saved in your profile will be used to check if Home Pickup is available at your home address. If Home Pickup is available at your address, you may select your preferred pickup date and you will be prompted to enter details about the item(s) being picked up. You may include up to three (3) Items per pickup request.
We will send you automated emails to confirm your scheduled pickup date, provide service-related updates, facilitate the provision of Home Pickup, and fulfill other obligations under these Terms and Conditions. Where you have opted in, we may also communicate with you via push notifications for these same purposes.
Your scheduled pickup date must be on a Business Day. A “Business Day” is a day other than the following: Saturday, Sunday, a statutory holiday, or any day observed as a holiday by Canada Post. Home Pickup is not available for same-day pickups.

How to Reschedule or Cancel a Home Pickup.
To change your scheduled pickup date, you must first cancel your existing scheduled pickup date through the App and then schedule a new pickup date. To cancel a scheduled pickup date, go to your profile in the App, navigate to Orders, select the scheduled pickup date you wish to cancel, and choose Cancel Order. Cancellations must be received prior to 7:00 a.m. on the scheduled pickup date.

Missed Pickup.
You must ensure that Item(s) are ready and accessible for pickup on the scheduled pickup date. If a scheduled Home Pickup attempt is missed because you are unavailable or the package is not ready for pickup, you will still be charged for the attempted Home Pickup. You will receive a Missed or Failed Pickup Attempt notification via e-mail and push following the unsuccessful Home Pickup. You may reschedule a new Home Pickup in accordance with these Terms and Conditions for an additional fee or you may choose to drop off your Item(s) at a nearby Canada Post location at no additional fee.

Failure to Comply with Terms and Conditions.
Canada Post, in its sole discretion, may reject any Home Pickup request and/or cancel any scheduled Home Pickup that does not comply with these Terms and Conditions. In addition, any package that fails to comply with these Terms and Conditions may be rejected by the delivery agent, returned to sender, or otherwise not delivered.

Fees.
Home Pickup will be offered for a non-refundable fee per pickup request. Canada Post shipping fees are charged separately and are not included as part of the Home Pickup service.

Disclaimers.
We have taken considerable care to prepare and maintain Canada Post’s mobile application (the “App”). HOWEVER, WE ARE PROVIDING THE APP AND ANY HOME PICKUP SERVICE YOU REQUEST STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. Your use of the App, request for Home Pickup, and/or use of the Home Pickup service is at your sole risk. Canada Post disclaims all warranties, expressed or implied, including implied warranties of accuracy, merchantability and fitness for a particular purpose.
We may at any time without notice suspend or terminate operation of the App and/or your access to the App or any portion of the App.

EXCLUSION OF LIABILITY.
WITHOUT LIMITING ANY OTHER LIMITATIONS OF LIABILITY THAT APPLY TO CANADA POST’S PARCEL SERVICES AND/OR THE APP, IN NO EVENT WILL CANADA POST, ANY AFFILIATE OF CANADA POST, AND/OR ANY EMPLOYEE, OFFICER, DIRECTOR, OR REPRESENTATIVE OF CANADA POST OR ANY AFFILIATE OF CANADA POST (EACH OF THE PREVIOUSLY MENTIONED PARTIES, INDIVIDUALLY AND COLLECTIVELY, BEING THE “CANADA POST PARTIES”) BE LIABLE FOR ANY LOSS OR DAMAGES WHATSOEVER ARISING OUT OF, OR OTHERWISE RELATED TO: (i) YOUR USE AND/OR ATTEMPTED USE OF HOME PICKUP, (ii) THESE TERMS AND CONDITIONS, OR (iii) CANADA POST’S DELIVERY, ATTEMPTED DELIVERY, OR FAILURE TO DELIVER ANY ITEM. THIS EXCLUSION OF LIABILITY APPLIES NO MATTER WHAT KIND OF LOSS OR DAMAGE YOU EXPERIENCE, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, GENERAL, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR OTHER DAMAGES.
THIS EXCLUSION OF LIABILITY APPLIES:
(1) WHETHER THE ACTION IS IN CONTRACT, TORT OR OTHERWISE;
(2) EVEN IF CANADA POST IS EXPRESSLY ADVISED OF THE POSSIBILITY OF LOSS OR DAMAGES; AND
(3) NO MATTER WHAT CAUSED THE LOSS OR DAMAGES, INCLUDING WITHOUT LIMITATION CANADA POST’S NEGLIGENCE AND/OR GROSS NEGLIGENCE.THIS EXCLUSION OF LIABILITY APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity.
You will indemnify the Canada Post Parties against all demands, damages, losses, fines, expenses (including all legal fees and costs) and/or any other types of liability (individually and collectively, the “ Losses”) to the extent the Loss is caused by: (i) your breach of these Terms and Conditions, and/or (ii) your use and/or attempted use of Home Pickup. We may, in our sole discretion, assume the exclusive defence and control of any lawsuit otherwise subject to this indemnification by you. Even if we assume the defence of a lawsuit, you will remain responsible for the payment of the lawsuit, and you will cooperate as fully as reasonably required by us in the defence of any lawsuit.

Other Terms and Conditions.
These Terms and Conditions and your use of Home Pickup (including the use of the App) are also subject to the following:

The Canada Post Postal Guide; and

The Canada Post Terms of Use.
For the avoidance of doubt, and notwithstanding anything to the contrary, outbound packages continue to be subject to the General Terms and Conditions.

Canada Post Corporation Act.
Notwithstanding anything else in these Terms and Conditions or any other document, your use of Canada Post’s Home Pickup service is subject to the provisions of the Canada Post Corporation Act and its Regulations (the “Act”). To the extent there is any conflict between the Act and anything else, the Act will govern.

Amendments.
We may change these Terms and Conditions at any time without notice. It is your responsibility to check the App regularly for changes. Your continued use of the Home Pickup service following the posting of changes to these Terms and Conditions will mean that you accept and agree to the changes. Without limiting the foregoing, we may change or terminate Home Pickup at anytime without notice.

Governing Law & Jurisdiction.
These Terms and Conditions and all disputes or other matters arising out of the use and/or attempted use of the Home Pickup service will be governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of law principles. Any dispute will be dealt with solely by a court of competent jurisdiction in Canada.

Entire Agreement.
Unless otherwise stated herein, these Terms and Conditions and any documents referenced herein state the entire agreement and supersede all prior agreements or understandings, whether written or oral, with respect to its subject matter.

Severability.
If any provision or any part of any provision of these Terms and Conditions is held to be unenforceable, invalid, or illegal, then it shall be severable and deemed to be deleted, and the remaining provisions shall remain valid and binding.

Survival.
The terms of these Terms and Conditions that by their nature are intended to survive the termination or expiration of these Terms and Conditions shall survive.

Headings/Interpretation
Headings in these Terms and Conditions are included for convenience only, and not for purposes of interpretation. The words in these Terms and Conditions shall be interpreted simply according to their fair and plain meanings, and not strictly for or against either party, regardless of which party drafted these Terms and Conditions or any specific provision.

No Waiver
Failure of a party to insist on strict adherence to any term or provision of these Terms and Conditions on any occasion or the waiver of a breach of these Terms and Conditions in any instance will not deprive the party of the right thereafter to insist on strict adherence to that term or provision or any other term or provision in these Terms and Conditions or be construed as a waiver of any subsequent breach, whether or not similar.
